This webinar presented by BJ Jones, Tribal Judge and Executive Director at TJI and Michelle Rivard Parks, Tribal Judge and Associate Director at TJI and former Tribal prosecutor. This webinar included a discussion on both civil commitments and criminal competency issues in criminal proceedings in Tribal courts. The discussion on Civil Commitments in Tribal Courts included the following topics: Common issues that give rise to civil commitment proceedings such as mental health issues and substance misuse Civil process for addressing these issues including evaluations and assessments Tribal Codes to support civil commitments Important provisions to include in civil commitment orders The discussion on Criminal Competency Issues in Criminal Proceedings included the following topics: Defining criminal competency Common issues that give rise to competency proceedings such as mental health issues Criminal process for addressing these issues including evaluations and assessments Placements of individuals determined to be incompetent to stand trial Tribal Codes to support criminal competency proceedings.
