Sedgwick County Juvenile Detention Facility, located in Wichita, Kansas requested assistance with fulfilling the requirements of several corrective actions as a result of a Field Training Program (FTP) audit. Standard 115.371; criminal and administrative agency investigations, contains five corrective actions to be addressed. This will also include recommendations to the current policies and procedures after consultant reviews, language recommendations for a Memo of Understanding (MOU) or similar documentation with the Sedgwick County Sheriff's Office regarding criminal investigations, suggestions for documentation and retention of correspondence and process creation for conducting credibility assessments.
o Assist with developing a protocol which is adapted from or otherwise based on the most recent edition of the U.S. Department of Justice's Office on Violence Against Women publication, "A National Protocol for Sexual Assault Medical Forensic Examinations, Adults/Adolescents," or similarly comprehensive and authoritative protocols developed after 2011.
o Ensure that the PCM and other facility leadership are aware of all community support services and their duty to coordinate such services. Ensure the services are available to alleged victims of sexual abuse and sexual harassment and that the PCM knows when to make the services available to the residents. Ensure these efforts are documented as required.
o Ensure that the in-person services from a Rape Crisis Center or victim advocate from a community-based organization are made available to alleged victims of sexual abuse and sexual harassment or that a trained, qualified staff member is available to assist. Ensure the referral and delivery of such services are documented.
o Review current administrative investigative process and analyze and further need for change.
o Assist with developing a process for conducting credibility assessments; outlining how investigators will review prior complaints of the alleged perpetrator; and how they will assess the credibility of an alleged victim, suspect, or witness on an individual basis and not based on that individual's status as resident or staff.
o Assist with establishing a records retention practice of correspondence with the Sedgwick County Sheriff's Office that:
o Document written reports that include a description of the physical and testimonial evidence.
o Documentation of a thorough description of physical, testimonial, and documentary evidence.
