In collaboration with the Justice Programs Office at American University and in furtherance of the goals of the BJA-led Right to Counsel National Campaign, NACDL will help further the goals of the R2C initiative by recording and disseminating podcast with thought-leaders in the area of the right the counsel and public defense reform.
The Right to Counsel National Campaign (R2C) is a public awareness initiative that uses value-based communication tactics to inform policymakers, criminal justice stakeholders, and the public about the importance of carrying out the Sixth Amendment’s right to counsel, the ways in which this right is not being implemented, the roles everyone from law enforcement officers to prosecutors to judges and court managers can play in ensuring that the constitutional right to counsel is upheld, and how to reform the public defense system with low-cost or no-cost policy solutions. R2C also seeks to elevate the defender voice in criminal justice reform conversations and provides new opportunities for citizens to become engaged advocates, ensuring effective public defense delivery systems in all courts across the country.

In June 2017, NACDL identified Judge Michael Kwan, the judge who presides over the Taylorsville Justice Court in Taylorsville, Utah, as a judge who was active in public defense reform and supporting the right to counsel. After Judge Kwan agreed to be interviewed, NACDL communications staff member, Alexandra Funk, researched, wrote, and edited proposed interview topics and questions. Following feedback from Judge Kwan, on July 13, 2017, Funk interviewed him in Provo, Utah.
Following the interview, Funk listened to and edited the recorded conversation in order to efficiently organize and design the podcast’s structure. After doing so, Funk wrote a script for the podcast, which included editing audio clips from Judge Kwan and researching public defense-related developments in the U.S., broadly, and Utah, more specifically. The remaining tasks for the completion of this podcast include final edits of the script, recording Funk’s voice into the episode, final edits of the audio clips, publication of the file, and dissemination of the episode to iTunes via NACDL’s podcast program – “The Criminal Docket”, NACDL’s webpage and social media accounts, the Right to Counsel National Campaign’s webpage and social media accounts, and any other interested individuals and organizations. NACDL’s podcast program, “The Criminal Docket” has been downloaded 81,000 times since its inception. The anticipated release date for this podcast is March 1, 2018.
