In October, CSG Justice Center Phase II team presented to the Phase II Justice Reinvestment Steering Committee on the impacts of West Virginia’s justice reinvestment policy framework and implementation to date. The Steering Committee is chaired by the Governor, and also includes cabinet secretaries from the Department of Health and Human Resources (DHHR), the Department of Military Affairs and Public Safety (DMAPS), and the chief administrator of the West Virginia Supreme Court of Appeals.
At the convening, state leaders reviewed information and policy options presented by CSG Justice Center staff and considered next steps to sustain the impact of justice reinvestment. The presentation summarized findings and recommendations resulting from an extensive analysis of West Virginia data trends and justice reinvestment implementation conducted by CSG Justice Center staff, and touched on several main themes, including:
• West Virginia has realized, and even exceeded, many of the state’s justice reinvestment goals;
• Substance use continues to be a significant driver of the state’s prison population; and
• In order to sustain the impacts of justice reinvestment, state leaders will need to maximize outcomes from the annual $3 million investment in community-based treatment resources.
Under the direction of the Governor, in response to the CSG Justice Center’s presentation, state leaders decided to take immediate action to sustain the state’s investment in community-based services by maximizing Medicaid. The Steering Committee also requested that an inter-agency, inter-branch sustainability structure be established to ensure continued coordination on key policy provisions, with support from the state’s Justice Reinvestment Coordinator (referred to by leaders as the JRI Coordinator). Finally, the Steering Committee requested that an inter-agency, inter-branch working group be established to expand upon current data monitoring and performance measurement efforts related to justice reinvestment.

• CSG Justice Center staff will be preparing communication products – including a blog post and informational graphic – highlighting West Virginia’s impacts resulting from the state’s justice reinvestment policy framework and implementation.
• CSG Justice Center staff will be providing expert input regarding continued inter-agency and inter-branch collaboration and performance measurement as West Virginia state leaders determine next steps for sustainability.
• CSG Justice Center staff will be continuing to monitor monthly data provided by the Division of Corrections (DOC) and the West Virginia Division of Probation. In order to prevent backsliding, will continue to hold periodic calls with state leaders and the JRI Coordinator to check in regarding justice reinvestment implementation progress. The first of these calls are scheduled for November 2015.
• CSG Justice Center staff will continue to monitor the spend-down of West Virginia’s subaward. West Virginia was granted a no-cost extension to continue spend-down through March 2016. The state encountered significant delays with certain grant deliverables, and is now receiving targeted technical assistance from the CSG Justice Center to ensure that remaining deliverables are accomplished by March.
• CSG Justice Center staff will be preparing a formal memorandum for justice reinvestment funders documenting technical assistance received by West Virginia under Phase II of justice reinvestment, and the resulting impacts.
