County commissioners control funding to local justice systems and they should use data to shape their funding decisions. Commissioners were encouraged to approach their local judges, prosecutors, sheriff, and other stakeholders to discuss important issues, such as: 1) use of an empirically based pretrial risk assessment to guide the court’s decision to release or detain newly arrested defendants before trial, 2)
ensuring the risk assessment tool does not contribute to racial and ethnic disparity, and that it accurately predicts pretrial success for that jurisdiction’s defendants, and
3) the number and percentage of low- and medium-risk pretrial defendants in the jail, why they are there (e.g., inability to pay cash bail), and what the jurisdiction can do to return them to the community where they can work, pay taxes, take care of their families, and be accountable to return to court.
