California voters enacted Proposition 47 in November of 2014, reducing the classification of various property and drug offenses that were previously prosecuted as felony offenses to misdemeanor offenses.
The Los Angeles City Attorney’s Office prosecutes misdemeanor offenses in the City of Los Angeles, and as we anticipated, experienced a significant increase in the number of drug offenses prosecuted by our office, increasing 224% following the passage of Prop 47.
However, following the passage of Prop 47, we also observed an increase in our prosecutions for certain other offenses, most notably theft offenses. Our prosecutions for petty theft increased from 1,532 cases in the first five months of 2014 to 2,012 cases in the first five months of 2015, an increase of 31%. Prosecutions for theft from motor vehicles increased 38%. Prosecutions for all offenses (excluding vehicle offenses) increased 13%.
Our law enforcement partners with the Los Angeles Police Department and the Los Angeles Sheriff’s Department report an increase in Part 1 crimes, and especially property crimes in their jurisdictions, with an overall 12.8% increase reported by LAPD and a 6.5% increase reported by LASD.
We are seeking assistance in evaluating arrest and prosecution data to determine if these observations are correlated, and if a cause and effect conclusion can be drawn.
