Between July and January, the CSG Justice Center provided Phase I intensive technical assistance to Michigan. CSG Justice Center staff conducted detailed data analyses and stakeholder engagement, including in-person meetings, conference calls, focus groups, webinars and on-site presentations, and planning sessions in these states with various state policymakers and relevant criminal justice leaders.
For Michigan, CSG Justice Center staff worked with state stakeholders to build a consensus around the recommended policy framework and later with state legislators and leadership from the Governor’s office leading up to introduction an passage of legislation. Two bills were passed in December. HB 5928 creates a new Criminal Justice Policy Commission, which will work for four years to analyze and make recommendations on changes to the state's sentencing and criminal justice systems. HB 5929 modifies and updates the existing Community Corrections Act to focus both funding and metrics for success among state funded community corrections programs based on the goal of recidivism-reduction.
CSG Justice Center staff also worked with current and former Justice Reinvestment states to identify key state stakeholders to attend the Justice Reinvestment Summit in San Diego in Fall 2014. CSG Justice Center staff at the Summit used the time to help facilitate dialogue and cross pollinate ideas between states that have been through the justice reinvestment process, are currently participating, and are interested in becoming a justice reinvestment state. CSG Justice Center staff teams were also able to use this time to work through state-specific issues.

In July, the CSG Justice Center staff presented at the Sentencing and Justice Reinvestment Policy Forum in Lansing, Michigan on July 1, 2014. The staff walked three separate panelists of stakeholders and practitioners through the CSG Justice Center findings and policy options, and facilitated discussions and feedback between the panelists and members of the audience. 90th District State Representative and Michigan Department of Corrections Director introduced the forum, and nearly 100 people attended and participated. The feedback from the forum has helped the CSG Justice Center team better appreciate points of contention and consensus around the policy options identified to help Michigan address challenges in its sentencing and criminal justice systems.
In addition to the policy forum, the CSG Justice Center team prepared for and presented at seven meetings in different regions and cities across the state (Grand Rapids, Traverse City, Bay City, Pontiac, Lansing and Benton Harbor). These meetings provided opportunities to present the findings and policy options to new audiences of stakeholders and elicit their feedback and reactions. In totality, approximately 150 people, including presidents of statewide associations and members of the legislature, attended the meetings.
The CSG Justice Center team has also continued in its efforts to draft and revise summaries of analysis and a policy framework in preparation to share with stakeholders in early August.
• CSG Justice Center staff gained increased insight into the concerns many stakeholders have about the current policy options we have presented, including:
o The negative impacts of further reduced judicial discretion, from the perspective of prosecutors and defense attorneys who rely on judges to account for "un-scored" factors, mitigating and otherwise, in making their final sentencing decisions.
CSG Justice Center staff are working closely with leadership of the Prosecuting Attorneys Association of Michigan, the Michigan Judges Association, State Appellate Defense Attorneys of Michigan and the Criminal Defense Attorneys of Michigan to address these concerns and find areas of consensus.
o Sheriffs are generally supportive of the principles and objectives behind many of the policy options, though they have expressed concern about a shift in populations from state prisons to county jails and what additional resources will be required to achieve positive outcomes from policy changes like statewide adoption of swift and sure probation supervision practices. CSG Justice Center staff are continuing conversations with leadership within the Michigan Association of Counties and the Michigan Association of Sheriffs to ensure that state costs are not shifted to the county level and funding concerns are addressed.

o Policy Forum co-hosted with the MLRC comprised of three panels, with the goal of developing more specific policy options for Michigan to consider. In August, CSG Justice Center staff widely distributed a draft analysis summary and policy framework to stakeholders across the state for their written feedback and commentary. CSG Justice Center staff also scheduled conference calls with Michigan stakeholders to receive their feedback and concerns on the distributed policy framework and had conversations with leadership representing prosecutors, defense attorneys, sheriffs, police, citizen policy groups, the Michigan Department of Corrections and legislative leadership.
CSG Justice Center staff also coordinated with the Michigan Department of Corrections on policy impact modeling with the goal of distributing models for the proposed policy framework among state legislators and stakeholders by late September or early October.
In September the CSG Justice Center team will meet with key legislative and criminal justice stakeholders to continue discussion and receive feedback on the distributed policy framework, as well as presenting to key Michigan business leaders and the State Bar of Michigan to share information on the JRI project.
• Stakeholders are supportive of various aspects in the draft policy framework, and concerned about other areas and recommendations within the framework.
• The Michigan Sheriffs Association and Michigan Association of Counties are eager to review impact models to better understand how suggested policy changes will affect local resources and public safety.
• The Michigan Law Revision Commission is supportive of forming a stakeholder working group to review future policy framework drafts throughout the fall. This working group will help shape and inform a final policy framework for the MLRC’s consideration and possible adoption as a resolution to recommend to the legislature.

In September, CSG Justice Center staff traveled to Michigan to brief legislators on the status of the project and provided updates on stakeholder conversations and concerns. CSG Justice Center staff also presented at a breakfast meeting in the State Capitol, with 90th District State Representative serving as host. This presentation allowed a wider audience of lawmakers to learn about the project's objectives, the data analysis and policy options from the May report, as well as the direction for a policy framework for legislative consideration later in the fall. CSG Justice Center staff also presented at a meeting of business leaders, convened by Governor Snyder's staff. This was another opportunity to introduce a wider group of stakeholders to the project, and to discuss the concerns of Michigan's business community. CSG Justice Center staff also presented to an audience of state bar members at the Michigan State Bar's annual meeting in Grand Rapids.
Throughout September, CSG Justice Center staff continued discussions with stakeholders regarding the development of a revised policy framework in preparation for a workgroup meeting in October. CSG Justice Center staff also began modeling impacts of policy options that may remain in this framework, and continued conversations with Michigan Department of Corrections staff for their assistance with additional policy modeling.
Many stakeholders indicated concerns with a first draft of a policy framework made available in August, but are more amenable to revisions in a second policy framework draft that will be discussed in October. In particular, the state's sheriffs (as represented by the state association) are worried about the potential for increased jail populations in counties whose jails are already near or at their capacity. Prosecutors, judges and defense attorneys all expressed concerns over eliminating straddle cells from the state's sentencing guidelines, and explained that in many cases judicial discretion is a necessary. At the same time, prosecutors indicated they are open minded to policies that would create more certainty in time served in prison, as well as adopting swift and sure sanctioning as statewide practice in probation supervision.

There were not any new data analyses, but models for impact estimation were developed. The models were built to allow estimation of the policy recommendations on capping lengths of stay in prison or jail for administrative violations of probation and parole. The models were built such that three different scenarios could be simulated. One scenario would cap length of stay for administrative violations of probation or parole at 60 days. The other two scenarios used capped lengths of stay of 45 and 30 days respectively. The scenario using a 60-day cap yields a reduced bed demand of almost 2,000 beds by the end of calendar year 2020, and the scenario using a 30-day cap yields a reduced bed demand of almost 3,000 beds

In October, CSG Justice Center staff traveled to Michigan multiple times to participate in ongoing stakeholder conversations to address feedback on the proposed policy framework. CSG Justice Center staff led three Workgroup meetings hosted by 90th District Representative and Senate President Pro Tempore that were attended by key stakeholders. The goal of these Workgroups was to arrive at consensus across organizations and different perspectives on what may be presented to the Michigan Law Revision Commission for their recommendation for legislative consideration in November.
Throughout October, CSG Justice Center staff continued to share the modeling impacts of policy options that may remain in this framework, as well as modifying some of the modeling impacts. This included ongoing conversations with Michigan Department of Corrections staff for their assistance with additional policy modeling and communication with Jail Administrator (Macomb County Sheriffs Office), the county-level appointed point of contact for understanding CSG Justice Center’s impact modeling.
Finally, CSG Justice Center staff dedicated time to reaching out to Michigan stakeholders to attend the upcoming Justice Reinvestment Summit.

Focused on documenting impact estimation modeling and working with the MDOC research staff on presumptive parole modeling based on policy recommendations. Had multiple conversations with Jail Administrator (Macomb County Sheriffs Office) to explain process for estimating the impacts and how they would play out at the county level.

In November, CSG Justice Center staff traveled to Michigan twice to present the recommended policy framework to the Michigan Law Revision Commission and to testify on the legislation at the first State House committee meeting shortly after the policy framework was introduced. HB 5928-5931 passed the House Appropriations Committee to the House floor for consideration.
Throughout November, the policy framework was adjusted based on stakeholder consensus and CSG Justice Center staff modified the modeling impacts of these policy options to help inform the discussion. This included conversations with Michigan Department of Corrections staff for their assistance with additional policy modeling.
In late November, a Michigan delegation also attended the Justice Reinvestment National Summit in San Diego to learn about the successes and challenges that other JR states experienced in the past and to discuss the legislative next steps for Michigan’s JR project. Attendees from Michigan included Executive Director (Michigan Sheriffs Association), Vice Chair (MLRC), 2 Prosecuting Attorneys from PAAM, Public Affairs Associate (PAAM), Presiding Judge (3rd Judicial Circuit Court), Director (MDOC), Division Administrator (MDOC), Legislative Assistant (MDOC), Defense Attorney (Criminal Defense Attorneys of Michigan) and Defense Attorney & Manager (State Appellate Defender Office).

In December, CSG Justice Center staff traveled to Michigan to continue engaging stakeholders regarding the justice reinvestment policy framework and to present before the Governor's Commission on Law Enforcement and Reinvention. CSG Justice Center staff shared analyses involving estimated impacts of the justice reinvestment policy framework and possible modifications as well discussions involving the data analysis and research foundations to the policy framework. CSG Justice Center staff had extensive conversations with the Michigan Department of Corrections, House Republican policy, and Governor's office staff as their review of the justice reinvestment policy framework continued.
