Part I: Minnesota, like jurisdictions across the country, has struggled with the persistent under representation of certain racial and ethnic minorities in its jury pools. In this comprehensive fair cross-section training we will cover some of the factors that contribute to those racial and ethnic disparities, why diverse juries matter, how the fair cross-section requirement differs from equal protection, as well as some model practices for improving jury diversity.
Part II: This training will help equip defense attorneys on how to bring fair cross-section motions. Taught by leading jury expert, Professor Nina Chernoff, defenders will learn what courts get wrong about fair cross-section challenges, how to properly establish a prima facie challenge, what you should know about your jurisdiction's jury system, and what pitfalls to avoid.
January - June 2022: Completed both trainings and provided written materials to participants. As a result of this training, defense attorney and district attorney made a joint filing with the courts about diversifying juries.
