Allegheny Co SAKI is starting their inventory, and they have questions about what do to about Pennsylvania’s requirement for the victim to give consent to have the kit tested. For these kits, that would be most likely pre-SAFER where it was a yes or no question. But, they might have some kits after SAFER where they reported that the consent language is quite confusing.
They are unsure of what to do if the consent isn’t on the outside of the SAK but instead inside.
Paige recommended getting in touch with the Site Coordinator at Philadelphia SAKI who would have gone through something similar. Paige is going to connect them with Jon Kurland from AEquitas who lives in PA.
Paige coordinated with Jon Kurland at AEquitas to get a call scheduled between him and the site.
Allegheny Co SAKI and Jon Kurland met about the PA requirement to consent to testing.
We essentially landed that the safer bet under the law is not test unless there’s consent. It’s okay to open to see if there’s a consent to test inside, but if any more of those kits end up being anonymous, just make sure to document what occurred. We also talked about that this might be a good issue to bring up when deciding how they want to land on a victim notification protocol for untested kits (i.e., on weighing whether to notify when an untested kit is discovered vs. only if there’s a hit).
