She had a concern about a few cases that we want to submit and wanted your opinion or guidance. The cases are cases that we have a conviction on but they were for lesser degree sexual assaults or pled to something related. In these cases they were not required to submit a buccal to corrections upon sentencing so there DNA is not in CODIS. I want to submit these to get them in but the attorney raised the concern of finding another DNA profiles not the suspect. She would have to notify the defense attorney that there is ?new evidence? and it could now complicate a resolved case and maybe revictimize the victim. I don?t remember any conversations related to this but know this had to be addressed by some site already. Thoughts?
