CJI assisted the Department of Corrections (DOC) and the Pardon and Parole Board (PPB) in the preparation and implementation of the administrative parole policy.

As part of the transition to Phase II, CJI held meetings with the Pardon and Parole Board and the Department of Corrections. CJI also attended an Oklahoma for Criminal Justice Reform event and planning session.
Given the importance of the new parole policies, CJI staff have reviewed the new laws and have begun background research to prepare for Phase II assistance. CJI is also working with the Pardon and Parole Board to put together an implementation plan.
As part of the transition to Phase II, CJI held meetings with the Pardon and Parole Board and the Department of Corrections as well as internal information sharing/transition sessions.
CJI has been researching other states’ administrative parole and geriatric parole policies and procedures in preparation for assisting the Pardon and Parole Board with writing their new policies.
CJI is ready to begin intense support for the Pardon and Parole Board and Department of Corrections who are responsible for the policy with the largest impact (administrative parole). CJI brought the two agencies together to start to negotiate implementation responsibilities and develop an implementation plan. CJI has also provided the Pardon and Parole Board (PPB) with some examples for geriatric parole applications as PPB will create an application for their geriatric parole process.
CJI has facilitated an administrative parole planning meeting in late August with the DOC and Pardon and Parole Board and conducted analysis of eligible inmates. CJI also provided the Pardon and Parole Board with information for trainings they are hosting for their Board members and investigators on the legislation that passed in 2017 and 2018, with a focus on the policies that specifically impact the Board.
CJI continued to work with DOC to accurately estimate the number of people eligible for administrative parole as of November 1. CJI received additional data and is in the final stages of replicating the DOC analysis to verify their process. CJI worked with DOC on a plan for release and with the PPB to assist with messaging and training of Board members around administrative parole.
CJI drafted core messages for administrative parole and worked with Pew on a communications plan around the upcoming releases. These materials will be reviewed with DOC at an onsite planning meeting in early October.
CJI and the DOC reviewed the Pardon and Parole Board’s draft geriatric parole application and provided feedback. The Board is finalizing the application to prepare to launch the final application upon the effective date (November 1).
CJI continued to collaborate with the DOC to accurately estimate the number of people eligible for administrative parole as of November 1. CJI received additional data and was able to replicate the DOC’s methods and produce the same number of inmates eligible. The DOC will provide the list of inmates to the PPB in early November so the PPB can start working on the administrative parole docket.
CJI conducted a planning meeting with the DOC on October 3rd to discuss administrative parole release. CJI has drafted core messages for administrative parole and worked with Pew on a communications plan around the upcoming releases. The DOC requested assistance with communicating the “hard to answer” questions. CJI collaborated with Pew to answer the questions discussed to ensure the DOC is prepared for the first administrative parole release.
CJI designed flow charts to assist the PPB and the DOC with explaining how the administrative parole process works. A broader flow chart was created to show the process from initial parole eligibility to the approval or denial of parole for the PPB. A second more detailed flow chart was created that outlined each of the steps in the PPB and DOC administrative processes for administrative parole.
CJI provided feedback and assistance with the Frequently Asked Questions for administrative parole for the PPB website. PPB is waiting for one response to a question from the DOC before the FAQs go live online.
CJI created a flyer to explain administrative parole eligibility to inmates.
CJI met with PPB and DOC to review decisions and next steps needing attention. CJI also worked with both the DOC and the PPB on what performance measures they will collect to track the successes and challenges of administrative parole.
CJI was approved to provide limited technical assistance for the rollout of administrative parole.
Update: CJI presented to the Pardon and Parole Board in Oklahoma at its monthly meeting. The presentation focused on the administrative parole policy and the steps involved, implementation, other state examples, and its progress to date, including the collaborative work with the DOC and Parole Board.
During the site visit, CJI also met with Director Allbaugh and Dr. Pitman from DOC, Parole Board Executive Director DeLynn Fudge, and Parole Board member Kris Steele to discuss administrative parole and any challenges they hare facing.
Also in November, CJI provided to DOC:
• An interpretation on whether the violent offense exclusion for administrative parole applies to individuals ever convicted on a violent offense or those currently serving a sentence for a violent offense;
• An argument to include people in prison on a revocation among those who are eligible for administrative parole;
• A basic analysis on a draft administrative parole eligibility list to determine the offenses for which the people on the list are serving;
• An interpretation of statute and the state Constitution about whether Parole Board members are able to vote no on an individual who meets the statutory eligibility and criteria for this type of release.
• In January, CJI attended the Department of Corrections Public Safety Forum. CJI provided Director Allbaugh and Board of Correction member Adam Luck with talking points for their presentations. Talking points were also provided for the Attorney General and for all of the panel moderators.
• Court appointments have been made to the Pardon and Parole Board. Gov. Stitt’s appointments are expected mid-February.
• On March 13 during the Pardon and Parole Board’s monthly meeting, the Board approved its first administrative parole docket. Sixty-two individuals were approved for administrative parole.
